What is Object Sexual Penetration?
Object Sexual Penetration (OSP), Va. Code § 18.2-67.2, is punished identically to rape, by a minimum of five years to a maximum life imprisonment. In general, the act forbidden by OSP is the penetration of the labia majora or anus by an object. The object can be animate or inanimate. A finger is both an animate object and “any object.” Further OSP can be committed by one who controls the penetrating object or by causing the victim to penetrate himself/herself with the penetrating object.
Please note that when OSP is coupled with felonies such as "Abduction", the penalties can increase dramatically - particularly in the case of the minimum mandatory jail time. It is absolutely critical to speak with an attorney as soon as possible in order to preserve certain evidence and prepare your defense.
