What is Sexual Battery?
Virginia Code Section 18.2-67.4(iii) states that Sexual Battery occurs when the accused accomplishes sexual abuse against the will of the victim by force, threat, intimidation or ruse or upon an incapacitated or helpless victim. Sexual Battery is a Class 1 misdemeanor, which is punishable by up to 12 months in jail and a $2,500.00 fine.
What is Aggravated Sexual Battery?
Aggravated sexual battery is a felony punishable by 1 to 20 years' imprisonment and a fine of $100,000. A person can be charged with Aggravated Sexual Battery if it is alleged that they engaged in any one of the following three acts:
B. The defendant causes serious bodily injury or mental injury to the alleged victim; or
C. The defendant used or threatened to use a dangerous weapon.
